A "specialty occupation" is a profession that requires a college degree or higher to enter and includes such fields as architecture, engineering, mathematics, physical sciences, social sciences, medicine and health, education, business specialties, accounting, law, theology and the arts.
A job offer and sponsorship is required from an employer in the United States.
This visa is only good for the job in the designated company and is not transferable.
If the holder wishes to work for another company then another application for a work permit specific to the new company has to be applied for.

Applicant Requirements:

- A completed and signed Nonimmigrant Visa Application (DS-156 Form).
- A completed and signed Supplemental Nonimmigrant Visa Application (DS-157 Form), if aged between 15-55.
- Valid passport with 1 photo.
- Proof of Qualifications and Work Experience.
- Original Form I-797
- Form I-129, Petition for a Nonimmigrant Worker
- A letter from the petitioning employer that confirms their plan to employ the applicant.

To be considered a person with extraordinary ability the applicant must have sustained national or international acclaim in the field of science, art, education, business or athletics that can be proven through extensive documentation. The applicant must be seeking to enter the U.S. to continue work in their field of endeavor and it is expected that the entry of such a person will benefit the U.S. substantially.
Though employment offer (including labor certification) is not required, the applicant's must include with the petition convincing evidence that he or she is coming to continue work in the area of expertise.
The holder of this visa can work for any employer without the need of re-applying for a permit.

This is for persons of the professions holding an advanced degree or equivalent, or baccalaureate degree plus at least five years of progressive experience in the specialty, and persons of exceptional ability in the sciences, arts and business.
Professionals with Advanced Degrees: Members of the professions includes, but is not limited to, architects, engineers, lawyers, physicians, surgeons, and teachers in elementary or secondary schools, colleges, academia, or seminaries.
Persons with Exceptional Ability in the Sciences, Arts, or Business: Exceptional ability has been defined as something more than what is common and requires some rare talent or unique ability in a calling which requires that talent or skill.
A job offer from the prospective U.S. employer is required in order to qualify for this visa.

This visa is for professionals, skilled workers or other workers.
Professionals are defined as members of the professions who hold a baccalaureate degree. Members of the professions include, but are not limited to architects, engineers, lawyers, physicians, surgeons, and teachers in elementary or secondary schools, colleges, academies, or seminaries. It also includes any occupation for which a U.S. baccalaureate degree (or foreign equivalent) is the minimum requirement for entry into the occupation.
Skilled worker is defined as a person, who at the time of petitioning, is capable of performing skilled labor, requiring at least two years' training or experience, not of a temporary or seasonal nature, and for which there are no qualified workers available in the U.S.
Other worker is defined as a person who is to perform unskilled labor, requiring less than two years' training, not of a temporary or seasonal nature, for which qualified workers are not available in the U.S.
